1 Bankruptcy Questions
  1. If you receive a call or email from a Support Payor (SP) and the caller mentions bankruptcy, you can refer the question to the Cap Center. The telephone number is 602 542-9973 or email [email protected]. This phone number and email are to be used internally only. Do not give this information to the Support Payor (SP). The bankruptcies are worked by D. Mendoza for last names beginning with A-L and C. Kent M-Z. (This is the phone number and email address for child support bankruptcy purposes. This is an action that involves the Support Payor(SP) and should not be discussed with the Support Recipient (SR), although sometimes they are aware of this from being told by the Support Payor.
 
2 Bankruptcy Detail
  1. Please make sure you are checking the Bankruptcy Detail screen, which is located under Related Lists, before sending a request to issue enforcement notices. This is where the bankruptcy information is shown.
 
3 What We Cannot Do
  1. DCSS CANNOT take certain actions (such as enforcement/sending collection letters to the Support Payor while the bankruptcy case is going on, as this violates the stay in bankruptcy and could subject DCSS to sanctions.
  2. Chapter 13 can sometimes take five (5) years to complete.
  3. The child support debt is not dischargeable in bankruptcy, and the Support Payor (SP) still owes child support and any arrears. DCSS will continue to collect current support during the bankruptcy.
